Upon legal advice, ICAC investigations may result in prosecutions if there is sufficient evidence. The guidelines issued by the Department of Justice provide that a caution may be administered for minor offences when it is considered not in the public interest to prosecute. Apart from that, the ICAC also refers cases of misconduct or malpractice of government officers to government departments for consideration of disciplinary or administrative action upon the endorsement of the Operations Review Committee.
